Terms & Conditions of Purchase

  1. These terms and conditions of purchase are part of and incorporated in the Terms and Conditions of Use and Ionx Privacy Statement. We may change these terms from time to time without notice to you. Changes will apply to any subsequent orders received. It is your responsibility to read these terms and conditions before each purchase. By placing an order you are explicitly agreeing to these terms and conditions. If you have any queries about these terms, please contact us at legal@ionx.co.uk

  2. The Distance Selling Regulations do not apply to the sale or purchase of computer software. Customers must note that Ionx is under no obligation to cancel any order made, however this decision is at our sole discretion.

  3. Goods are subject to availability. In the event that we are unable to supply the goods, we will inform you of this as soon as possible. A full refund will be given where you have already paid for the goods.

  4. The price you pay is the price displayed on this web site at the time we receive your order. However, if we discover an error in the price of the goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

  5. If, in the unlikely event the goods you receive are faulty, you should return the goods to Ionx, within fourteen days, with a cover note explaining any defect and stating whether you would like a refund or replacement. This is to be carried out at your own expense. Once received, if Ionx deem the goods to be faulty, we will give a full refund or replace the goods, where payment has been made, and reimburse expenses incurred in returning the goods. If however, Ionx do not agree that the goods are faulty (for example, if software does not operate because a customer has overlooked computer specifications needed for operation) no refund, replacement or expenses will be given. Also, if the product is deemed faulty by you, the customer, and you do not return the goods within fourteen days, you will receive no refund, no replacement goods and no expenses for returning the goods. However, this decision remains at the sole discretion of Ionx.

  6. Payment can be made by any method specified by Ionx. We will take all reasonable precautions to keep the details of your order and payment secure, but we cannot be held liable for any losses caused as a result of, but not restricted to, interrupted internet transmissions or unauthorised access to information provided by you.

  7. Delivery will normally be made within 28 days. However, Ionx can not be held responsible for any delays, and in no way is this statement a guarantee or warranty of delivery.

  8. All payments must be made within 30 days of invoice date. If payment is not made within 30 days, a letter requesting immediate payment will be sent, and legal action may be taken. In addition, you will not be permitted to make any further purchases from Ionx until the full balance of all outstanding invoices is settled.

  9. The contract between you, the customer, and Ionx shall be governed by Scottish Law and any dispute between us shall be resolved exclusively in the Courts of Scotland.
